Bad Service Complaint

Dear Sir / Madam

WITHOUT PREJUDICE

My name is Mr Yanno Stuart Zamudio & I've bought my mobile phone in January 2014 in Mauritius & I really like this phone.

The salesman, at time of purchase certified to me that this phone was waterproof up to a limit of 5-10 meters in SALINE and non-saline water, and that I could take photographs under water...which is not true. The seller also told me that if any problem arouse due to water or waterproof problem with the screen or mobile itself, it would be covered and that the company from which I bought that phone would restitute the phone in perfect condition to me.

Nevertheless I never used this phone in a saline water, never had any modifications, nor tampering, etc...

After one month of use, i was at the pool and I firmly attached all covers before entering the pool. After less than 5minutes in non-saline water, the phone started to work and would not switch on. I brought the phone to the local seller "Galaxy" and the phone started to work again.

I was recommended by a salesman to bring back the phone if ever this problem arise again.

Last month, in November, I was at the hotel and just before entering the pool,I once again firmly attached all covers before entering the water. As soon as I was in the pool to take some photos, in less than 3minutes the phone switched off and did no more switch on.

The next day I brought my phone to the local seller and they took my phone to so the repairs. However, after 2weeks I was informed that the damages were due to oxidation and that the warranty for the phone was void.

In fact as per the phone booklet, oxidation is not covered, however I'm surprised that such a sophisticated phone which I bought at such a high price and which is certified being waterproof has got oxidation??

I only used this phone twice in water in a maximum depth of 1m35 and had problems with it both times. I wonder if the phone which was sold to me is a defective one since I had another problem with this phone which had a problem of overheating after 15minutes of use.

None of the technicians of "Galaxy" & "Linxia Ltd" which is the local supplier in Mauritius can explain how the problem of oxidation happened but are not willing to repair my phone or replace it since they aver that I'm guilty for the problem of oxidation

I would highly appreciate if you can assist me since I'm willing to refer to case to my legal counsel and sue the brand &/or the concerned parties for 'fake publicity', 'willful sale of defective products' & 'moral damages' for troubles incurred.

Note that I have this problem since one month and I'm really desperate to have this matter settled, hopefully by end of this week.

Freshwater not saline water
